By downloading or using Moon Tonight ("the app"), you agree to these terms. They are short, and we have tried to keep them in plain English.
Moon Tonight shows the Moon's phase, its illuminated fraction, moonrise and moonset times, and the dates of the next full and new Moon for your location or a place you choose. Phase, illumination and event dates are calculated on your device using standard published astronomical algorithms and are checked against published tables to within a couple of minutes; moonrise and moonset times come from a third-party provider (WeatherAPI.com). The picture of the Moon is an illustration: it shows the lit and dark portions and, in "Local sky" mode, the tilt of the lit edge for your place and time, but it does not reproduce the Moon's libration or the shadows along its edge, and the app makes no claim about whether the Moon is visible — cloud, horizon, daylight and local obstructions are outside its scope.
The app is an informational tool. It should not be used as the sole basis for decisions involving personal safety, navigation, tides, or any activity timed to the Moon. For authoritative data consult your national observatory or almanac.
You may use the app for personal, non-commercial purposes on devices you own or control. You may not reverse-engineer, resell, or misrepresent the app or its data as your own. The app's design, code, and content remain the property of Ostapenko Studio.
Remove Ads is a one-time, non-consumable purchase processed by Apple's App Store or Google Play. It permanently removes advertising from the app on devices signed in to the same store account, and can be restored at any time via "Restore purchases" in Settings. Refunds are handled by Apple or Google under their own policies, not by us directly.
The app depends on third-party services (WeatherAPI.com for moonrise and moonset times, your device's location and place-name services) that we do not control. We may update, change, or discontinue features at any time. We aim to keep the app working well, but we do not guarantee uninterrupted or error-free operation.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law, or under any other consumer protection law that cannot lawfully be excluded where you live. Subject to that, the app is provided "as is", and to the maximum extent permitted by law, Ostapenko Studio is not liable for any loss or damage arising from your use of, or reliance on, the app — including loss arising from inaccurate times, dates or illustrations. Where liability cannot be excluded but can be limited, it is limited to re-supplying the app or paying the cost of re-supply.
These terms are governed by the laws of Australia. Any disputes are subject to the non-exclusive jurisdiction of the Australian courts. This does not deprive you of the protection of any mandatory law of the country you live in.
How the app handles information — including the coordinates it sends to the weather provider and the place names it sends to your device's operating system — is set out in the Privacy Policy.
If these terms change, the updated version will be posted at this address with a new effective date. Continuing to use the app after a change means you accept the updated terms.
This English text is the canonical version of these terms. Translations are provided for convenience. Where a translation differs from this English text, the English text governs, to the extent local law allows. If you find a discrepancy between versions, please tell us and we will fix it.
